Welcome to Identity-as-a-Service, offered by IDmission, LLC. (“IDmission,” “we,” or “us”). This page describes the terms by which you may use our web and/or mobile software and services, which allow our business partners (“Clients”) to verify and vet the identities and credentials of individuals (collectively, the “Service”).

By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Service and to the collection and use of your information as set forth in the Service Privacy Policy.

THESE TERMS OF SERVICE CONTAIN A MANDATORY INDIVIDUAL ARBITRATION AND CLASS ACTION/JURY TRIAL WAIVER PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES.

1. USE OF OUR SERVICE

You understand that the technical processing and transmission of the IDmission Services may involve transmissions over various networks and changes to conform to technical requirements of connecting devices.

A. Eligibility

You must read and agree to these terms before using the Service. You may use the Service only if you can form a binding contract with IDmission and in compliance with all laws. Access by anyone under 18 is strictly prohibited.

B. What is the Service?

The Service is a technology offering that allows our business partners to verify and vet identities. Use of the Service implies agreement to these Terms and associated Privacy Policies.

C. How Does the Service Work?

A Client will direct you to our Service. We vet the information you submit and share it back to the Client. This does not change your direct relationship with the Client. You are responsible for your interactions with them.

D. Service Rules

Prohibited activities include: (i) scraping or distribution; (ii) automated system access; (iii) interfering with integrity; (iv) infrastructure overloading; (v) uploading invalid data; (vi) harvesting info; (vii) commercial solicitation; (viii) impersonation; (ix) bypassing measures.

Accepting these Terms opts you in to notifications via email or text for authentication purposes. Standard rates apply.

2. PROPRIETARY RIGHTS

The Service and all materials (software, logos, text, etc.) are the exclusive property of IDmission and its licensors. You agree not to distribute, copy, or create derivative works from any IDmission Content.

3. PRIVACY AND SECURITY

By using the Services, you consent to the collection and use of your personally identifiable information as set forth in our Privacy Policy. We use commercially reasonable safeguards to preserve data integrity, but cannot guarantee absolute security against unauthorized third parties.

4. THIRD-PARTY LINKS AND INFORMATION

The Service may contain links to third-party materials not owned by IDmission. We do not assume responsibility for such sites. Use of third-party websites is at your own risk.

5. INDEMNITY

You agree to defend and indemnify IDmission from claims arising from: (i) your use/access of the Service; (ii) violation of terms; (iii) violation of third-party rights; (iv) violation of law; (v) misleading data provided by you; (vi) willful misconduct.

6. NO WARRANTY

The Service is provided “as is” and “as available”. Use is at your own risk. To the maximum extent permitted by law, the Service is provided without warranties of any kind. IDmission does not warrant that the content is accurate or that the Service is free of harmful components.

7. LIMITATION OF LIABILITY

Except for specific breaches, in no event shall either party be liable for any indirect or consequential damages. IDmission's maximum liability for all claims shall not exceed the amount you paid or $1,000.00, whichever is greater.

8. GOVERNING LAW & ARBITRATION

Governing Law

The Service is based in Colorado, USA. These Terms are governed by the substantive laws of the State of Colorado.

Arbitration Notice

Disputes shall be referred to an Arbitrator under the Arbitration and Conciliation Act, 1996. You waive the right to a trial by jury or class action participation.

9. GENERAL

Terms are not assignable by you but may be assigned by IDmission. Notifications may be provided via email or website updates. California residents may report complaints to the California Department of Consumer Affairs.
